Foreclosure Help in the Western States

Thirteen states, and the deadlines are not the same in any two of them.

Choose your state

Most western states foreclose without going to court, which makes them faster than the judicial half of the country — but the notice periods swing enormously, from about three weeks to a hundred and twenty days.

  • Alaska — 90-day notice, and no deficiency after a trustee sale

  • Arizona — fast trustee sales under a deed of trust

  • California — the three-month rule, and reinstatement to five business days before the sale

  • Colorado — public trustee sales, a Rule 120 hearing, and cure until noon the day before

  • Hawaii — mostly judicial, slow, and no post-sale redemption

  • Idaho — 120-day notice and a modification request that blocks the sale

  • Montana — 120-day notice, reinstatement to the sale, and no deficiency

  • Nevada — the NRS 107.080 timeline and a real mediation right

  • New Mexico — judicial, with a redemption period your mortgage may have cut to one month

  • Oregon — mandatory resolution conference and no deficiency

  • Utah — a hard three-month notice-of-default period

  • Washington — Foreclosure Fairness mediation, and mediation stops the sale

  • Wyoming — short notice, but three months to redeem after the sale

What is true across the region

Nearly all of these states use a trustee sale rather than a lawsuit, so the clock is driven by recorded notices rather than a court docket. Several — Alaska, Montana, Oregon and Washington — largely bar the lender from pursuing you for a shortfall after that sale, which is one of the most valuable protections on this page. Post-sale redemption is rare here; Wyoming is the notable exception.
