Montana trustee sales come with the longest notice and no deficiency

Most Montana residential foreclosures are trustee sales of a trust indenture under the Small Tract Financing Act, which covers tracts of 40 acres or less. Judicial foreclosure of a conventional mortgage exists but is uncommon for homes.

Montana makes a clean trade with homeowners: a very long pre-sale notice and no deficiency exposure, in exchange for no redemption after the sale.

The 120-day notice

The notice of sale is recorded, and a copy must be mailed by certified mail to the grantor and other identified parties at least 120 days before the date fixed for the trustee sale. That is the longest mandatory pre-sale notice among the states covered here, and it cannot be compressed.

The notice must also be posted conspicuously on the property at least 20 days before the sale, and published at least once each week for three successive weeks, with the posting or last publication at least 20 days before the sale. Affidavits of mailing, posting and publication must be recorded on or before the sale date.

From first missed payment to sale realistically runs eight to eleven months.

You can reinstate right up to the sale

Montana lets you reinstate at any time up to the moment of sale by paying the arrears, costs, and reasonable trustee and attorney fees. Combined with four months of formal warning, that is a lot of usable time.

No redemption after the sale, and no deficiency

There is no post-sale redemption period after a Small Tract Financing Act trustee sale. Your leverage is entirely before the auction.

The counterweight is significant: where a trust indenture is foreclosed by advertisement and sale, no action or judgment may be taken for any deficiency against the grantor or a surety, guarantor or successor in interest. Montana also separately bars deficiency on foreclosure of a purchase-price mortgage.

In practice, a Montana homeowner who goes through a trustee sale generally walks away owing nothing.

What this means if you are behind in Montana

Montana has no residential foreclosure mediation program — its mediation program is agricultural. What it gives you instead is time: four months of notice and a reinstatement right that runs to the gavel.

Since the debt ends with the sale, the practical question is equity. A Montana homeowner with equity should be selling on their own terms rather than letting a trustee auction convert it into someone else's profit.
