Wisconsin foreclosures are judicial only

Every mortgage foreclosure in Wisconsin runs through circuit court. There is no power-of-sale track. You have 20 days to answer the complaint, and the judgment of foreclosure sets a redemption period that must expire before any sale can happen.

Here is the terminology trap: Wisconsin's redemption period runs before the sale, not after. Once the sale occurs and is confirmed, redemption is gone.

How long you have depends on two things

The redemption period runs from entry of judgment, and its length turns on when your mortgage was executed and which track the lender chooses.

Standard track: 12 months for mortgages executed before April 27, 2016; six months for mortgages executed on or after that date; eight months if you can show good-faith efforts to sell.

Deficiency-waiver track: where you agreed in writing at execution and the property is an owner-occupied one-to-four family residence, and the lender waives any deficiency and lets you keep possession, rents and profits through confirmation — six months for pre-2016 mortgages, three months for later ones, five months where there is a listing agreement.

Abandoned property: the sale may be held any time after five weeks from judgment.

The execution date on your mortgage is the single most consequential fact in a Wisconsin file. Check it.

The redemption-versus-deficiency trade

Wisconsin makes the trade-off explicit and statutory: a lender that waives its deficiency claim cuts your redemption period roughly in half. Your time in the house is directly priced against the lender's right to pursue you personally.

Many lenders take the trade. If yours has, you get less time but walk away clean.

The fair-value requirement at confirmation

Where the property sells for less than the amount due plus costs, no sale may be confirmed and no deficiency judgment rendered until the court is satisfied that the fair value of the property has been credited on the mortgage debt. There is no presumption that the auction price was fair value.

That is a real judicial check on lowball credit bids — something most non-judicial states lack entirely. You also get five days' notice of the confirmation hearing, stating the judgment amount, the amount realized at sale, and the amount of any personal judgment sought.

What this means if you are behind in Wisconsin

There is no statewide mediation program. Mediation runs county by county through the Wisconsin Foreclosure Mediation Network, usually with a Notice of Availability served alongside the complaint and a short opt-in window. Coverage has shrunk recently — Mediate Milwaukee closed in late 2025 — so confirm what is available in your county rather than assuming.

Between a redemption period of three to twelve months that runs before the sale, and a fair-value requirement at confirmation, Wisconsin gives an engaged homeowner real leverage. It gives an absent one very little.
