Delaware foreclosures are judicial — and the posture is reversed

Delaware forecloses by writ of scire facias sur mortgage in Superior Court. The action orders you to show cause why the property should not be seized and sold, which means you bear the burden of pleading a defense by affidavit.

That reversal makes the response deadline unusually costly to miss. Doing nothing is not neutral in Delaware — it is a loss.

The 45-day notice of intent

A notice of intent to foreclose must be sent after default by certified and first-class mail, and no foreclosure action may be filed until 45 days after it is sent. The notice must itemize the default, explain reinstatement, list housing counselors, and provide a 12-month account history.

The complaint must include the foreclosure mediation notice. You have 20 days to respond, though an answer is not untimely if filed on or before the scheduled mediation conference.

Mediation is automatic — you do not have to know to ask

Delaware's Automatic Residential Mortgage Foreclosure Mediation Program applies to owner-occupied one-to-four family primary residences, and mediation comes attached to the complaint rather than by request. That is rare and valuable.

The deadlines are firm: within 30 days of service of the foreclosure mediation notice you must meet with a HUD-approved housing counselor and file a Certificate of Participation with the court. Your completed financial worksheet is due to the plaintiff and mediator 14 days before the conference, and the conference is scheduled 45 to 75 days from service.

No judgment may enter until the day after the scheduled conference. The lender must also file a loss-mitigation affidavit before judgment on owner-occupied one-to-four family property.

The sale and redemption

The sheriff's sale is noticed at least 10 days before, with newspaper advertising for two weeks, followed by a court confirmation hearing roughly 30 days after the sale.

There is no post-sale redemption. You may redeem by paying the full debt plus costs up until the court confirms the sale; after confirmation the right is gone.

What this means if you are behind in Delaware

Delaware gives you an automatic mediation right and a 45-day pre-filing runway — genuinely good protections. Both are wasted if the Certificate of Participation is not filed within 30 days of service.

Calendar that date the day the papers arrive, and call a HUD-approved counselor the same week.
